in that capacity, and as the letter was sent to Hong Kong by the

Mexican Government and stationed there expressly for the purpose

of examining intending emigrants to Mexico in order that on

arrival there would be no difficulty or question of their being

landed, once passed by said Delegate. This appointment was

published as a news item in both the "Mexican Herald" (published

in England) and the "Imparcial" (in Spanish), both subsidized

by the Goverment, and there was no official denial of same.

But when the Co. advanced this point, then the Board of Health

disclaimed said appointment alleging that the Mexican Consul at

Hongkong had no right to make it and that by so doing he

infringed on the Powers and Authority of the Chief Executive of

the Nation. (Vide Departmental Regulations.)

That each and every one of the rejected passengers

possessed the individual bill of health as prescribed for by Art. 49 of the Sanitary Code (See page 6) according to which

it is the only requisite necessary to entitle the holder to a

landing on arrival. Excepting this, there is no other article

in the said Code nor in that of the Sanitary Maritime

Regulations nor even in any of the laws of the country, that

authorizes the refusal of a landing to any immigrant, and in

all the prophylactic measures provided for preventing the ---

introduction of infectious and contagious disceases, such as

"aurveyance and isolation of suspected passengers, isolation

"of sick passengers until they are completely cured",no mention

is made about rejection of passengers or a refusal of lading.

That the action of the Government was against their very

Constitution promulgated 1857. Article 11, Section 1, Title 1,

says.-

"Every person has the right to enter and leave the

"Republic, travel in its territory and change of residence,

"without the necessity of letter of security, passport,
